These Terms & Conditions govern your use of this website and any lessons, songbooks, journals, videos, memberships, or other digital products offered on it (the "Service"). The Service is operated by The Last Living Shepherdess ("we", "us", "our"), and you are contracting with The Last Living Shepherdess. You can reach us at thelastlivingshepherdess@gmail.com.

1. Acceptance of these terms

By visiting this site, creating an account, or purchasing anything from us, you agree to these terms. If you do not agree, please do not use the Service. If you are agreeing on behalf of an organization, you confirm you have authority to bind it; if you are agreeing as an individual, you confirm you are of legal age in your country.

2. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that happens under your account.

3. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for anything unlawful;
• engage in fraud, spam, or deceptive activity;
• infringe anyone's intellectual property or other rights;
• interfere with the security or integrity of the Service — including uploading malware, probing or scanning our systems, or scraping content by automated means;
• resell, redistribute, share, or publicly post the videos, PDFs, journals, or other files you download, or circumvent any technical limits on them;
• reverse engineer or attempt to derive the source code of the Service.

4. Licence to use our materials

When you buy a download or hold an active membership, we grant you a limited, non-exclusive, non-transferable licence to use the materials for your own personal, non-commercial learning and practice. Teachers wishing to use materials with students should contact us for permission.

5. Intellectual property

We retain ownership of the Service and all intellectual property in it, including the recordings, written material, artwork, branding, and software. Nothing in these terms transfers ownership to you.

6. Your content

If you post messages, questions, or other content through the Service, you grant us a limited licence to host and display that content solely in order to operate the Service. You remain responsible for what you post.

7. Payments, subscriptions, and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, applicable taxes, renewals, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Memberships renew automatically each billing period until cancelled; when you cancel, your access continues until the end of the period you have already paid for. 8. Service availability

We work hard to keep things running, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Content and pricing may change.

9. Warranties

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Our total aggregate liability is limited to the amount you paid us in the twelve months before the claim arose. Nothing here excludes liability for fraud, death, or personal injury where the law does not permit exclusion.

11. Indemnity

You agree to indemnify us against claims arising from content you submit, your unlawful use of the Service, or your breach of these terms.

12. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. When access ends, you may keep files you have already lawfully downloaded unless a refund or chargeback has reversed the purchase; access to streaming or member-only areas stops.

13. Changes to these terms

We may update these terms from time to time. Continued use of the Service after an update means you accept the revised terms.

14. Governing law and disputes

These terms are governed by the laws applicable where The Last Living Shepherdess is established, and the courts of that jurisdiction have exclusive jurisdiction over disputes, without limiting any mandatory consumer rights you have locally.

15. General

You may not assign these terms without our consent; we may assign them in connection with a merger or sale of the business. Neither party is liable for delays caused by events beyond its reasonable control. If any provision is unenforceable, the rest remains in effect.
